Terms of Service

These terms govern the contractual relationship between you, as a consumer, and the trader operating Trova il Tesoro. They regulate registration, payments, the right of withdrawal and liability. For the rules of the game please refer to the Rules; for the processing of data, to the Privacy Policy.
Subject of the service
Trova il Tesoro is a digital service that lets you take part in treasure hunts as pure-skill contests. The features of the service and the rules of play are described in the Rules, which form an integral part of the relationship. In case of conflict between the documents, these terms prevail for contractual matters, the Rules for game rules and the Privacy Policy for data processing.
Identity of the trader
The identity and contact details of the trader providing the service are shown in the site footer and in the Privacy Policy as data controller. You may contact the trader at the details indicated there.
Account and requirements
To take part you must create an account, provide truthful data and be at least 18 years old. You are responsible for keeping your credentials safe and for activity carried out through your account. Only one account per person is allowed.
Price and payments
The participation fee for a hunt is €10, VAT included. Payment is handled through Stripe; we do not store your card data. You will receive confirmation of the contract on a durable medium (for example by email) after payment.
Right of withdrawal
As a consumer, you have, in principle, the right to withdraw within 14 days of entering into the contract (art. 52 of the Italian Consumer Code).
However, as this is a service and digital content whose performance begins immediately, before payment we ask you for two separate, explicit declarations: (1) the request that performance begin before the 14-day period expires, and (2) the acknowledgment that, once the service has been performed with your consent, the right of withdrawal is lost, pursuant to art. 59(a) and (o) of the Italian Consumer Code. You will receive confirmation of the contract and of these declarations on a durable medium pursuant to art. 51(7) of the Italian Consumer Code.
Conformity of the digital service
We undertake to provide a digital service that conforms to the contract, in line with the protections set out in Italian Legislative Decree 170/2021. In the event of a lack of conformity you are entitled to the remedies provided by law.
User obligations
You undertake to use the service lawfully and fairly, not to falsify your location, not to tamper with tags or verifications and not to engage in fraudulent conduct. Breaches of the Rules may lead to disqualification and suspension of the account.
Intellectual property
The content, trademarks, software and graphics of the platform are protected by the intellectual property rights of the trader or its licensors. You are granted a limited, personal and non-transferable licence to use the service. The content you upload (for example selfies) remains yours and is used only for the purposes described in the Privacy Policy.
Limitations of liability
Our liability is limited to the extent permitted by law. We do not exclude or limit liability for wilful misconduct or gross negligence, for personal injury, or where the law does not allow it. The hunt takes place in the field and under your responsibility: you must act with care and in compliance with the places and applicable rules.
Duration, suspension and disqualification
The relationship lasts for the time needed to take part and to manage your account. We may suspend or disqualify an account in case of breach of the Rules or these terms, or for security reasons, in compliance with applicable law.
Dispute resolution
In the event of a dispute we invite you to contact us to seek an amicable solution. Your right to turn to the competent alternative dispute resolution (ADR) bodies and to the courts remains unaffected.
Changes to the terms
These terms are versioned. In case of substantial changes we will inform you and, where necessary, you will be asked to accept them again before continuing to use the service.
Governing law and jurisdiction
The contract is governed by Italian law. For disputes with consumers, the courts of the consumer's place of residence or domicile have exclusive jurisdiction. For consumers resident in other EU countries, the more favourable mandatory provisions of their country of residence remain unaffected (Rome I Regulation, Art. 6). No contractual choice of forum in favour of the trader applies.
